These Donation Terms and Conditions govern donations made to the Tiso Foundation Charitable Trust through the Foundation’s website or through any other donation channel made available by the Foundation from time to time.
For purposes of these Donation Terms and Conditions, references to the “Foundation”, “we”, “us” or “our” mean the Tiso Foundation Charitable Trust. References to “you” or “your” mean any person or organisation making, or intending to make, a donation to the Foundation.
These Donation Terms and Conditions should be read together with the Foundation’s Privacy Policy, Cookie Policy and Terms of Use. Where donations are processed through PayFast or another authorised third-party payment service provider, the payment processing component may also be subject to the applicable terms, privacy policy and security practices of that payment service provider.
By making a donation to the Foundation, you agree to these Donation Terms and Conditions.
Donations to the Foundation are voluntary contributions made in support of the Foundation’s charitable, educational and developmental activities and objectives.
Donations received by the Foundation may be applied by the Foundation in furtherance of its charitable, educational and developmental activities and objectives.
A donation does not create any ownership interest in the Foundation and does not entitle a donor to any benefit, programme participation, funding opportunity, preferential treatment or right to influence the affairs, decisions or activities of the Foundation.
The Foundation may decline to accept any donation where it considers this appropriate or necessary.
Donations may be made through the payment methods made available by the Foundation from time to time.
Online donations may be processed through PayFast or another authorised third-party payment service provider. The Foundation does not intentionally store full payment card details on its website.
A donation will only be regarded as received once the relevant funds have been successfully processed and received by or on behalf of the Foundation.
The Foundation is not responsible for the independent acts, omissions, systems, security practices or processing failures of any third-party payment service provider, except to the extent that liability cannot lawfully be excluded.
Subject to applicable law, donations accepted and received by the Foundation are intended to be irrevocable and non-refundable.
The Foundation may, in its discretion, consider a refund where there has been a duplicate payment, an unauthorised transaction, an obvious processing error, a technical error or where a refund is required by law.
Any approved refund may be subject to verification procedures and the requirements of the applicable payment service provider.
The Foundation may issue a donation receipt, acknowledgement or other confirmation of donation where appropriate.
Where applicable, and where the Foundation is legally entitled to do so, the Foundation may issue a section 18A tax certificate in respect of a qualifying donation.
The Foundation may require donors to provide such information and supporting documentation as may be reasonably necessary to issue a valid section 18A tax certificate and to comply with applicable legal, regulatory and reporting requirements.
The Foundation does not warrant that every donation will qualify for a section 18A tax certificate or any tax benefit. Donors are responsible for obtaining their own tax, legal or financial advice regarding the tax treatment of any donation.
If a donation is refunded, reversed or cancelled after a receipt or tax certificate has been issued, the Foundation may cancel, amend or withdraw the relevant receipt or certificate and update its records accordingly.
The Foundation may collect and process information relating to donors for purposes connected with the administration of donations, donor communications, receipting, tax compliance, record-keeping, reporting and the lawful activities of the Foundation.
Personal information provided by donors will be processed in accordance with the Foundation’s Privacy Policy.
The Foundation does not authorise any person to solicit donations, issue receipts, collect funds or conduct fundraising activities on its behalf unless expressly authorised to do so.
Donors should ensure that any payment link, banking details, communication or donation request originates from the Foundation’s official website, official email addresses or authorised representatives.
The Foundation will not be responsible for any loss suffered as a result of fraud, scams, phishing, unauthorised fundraising activities or communications that are not issued or authorised by the Foundation, except to the extent that liability cannot lawfully be excluded.
To the fullest extent permitted by law, the Foundation shall not be liable for any loss, damage, liability, claim, cost or expense arising from or in connection with a donation, a failed transaction, a payment processing issue, the conduct of a third-party payment service provider, fraud, phishing, unauthorised fundraising activity or any other matter relating to the processing of donations.
Nothing in these Donation Terms and Conditions excludes or limits any liability that cannot lawfully be excluded or limited.
The Foundation may amend these Donation Terms and Conditions from time to time to reflect changes in applicable law, payment processes, donation functionality or Foundation practices.
Any updated version will be published on the Foundation’s website and will apply from the date of publication unless otherwise stated.
